As reported in Appeals Court Declares Parenthood Unconstitutional, Group Says, the 9th Circuit dismissed a case brought by California parents who were “outraged over a sex survey given to public school students in the first, third and fifth grades.”

According to the report:

The parents argued that they — not the public schools — have the sole right “to control the upbringing of their children by introducing them to matters of and relating to sex.”

However, on Wednesday, the three-judge panel of the 9th Circuit said:

There is no fundamental right of parents to be the exclusive provider of information regarding sexual matters to their children. … Parents have no due process or privacy right to override the determinations of public schools as to the information to which their children will be exposed while enrolled as students.

At the risk of invoking Godwin's Law, are you sure we're not living in World War II-era Berlin? This story would follow that to the elite left, parents only serve as parents at the pleasure of the all-knowing, all-wise State, and that our children will be indoctrinated as to the mores and correct-thinking as dictated by their true parents--the State! Damn the wishes of the "sperm and egg-donors"!

This runaway "social engineering" aspect of an activist judiciary is most illustrative of the absolute imperative of why we need Originalists sitting on the Courts; and why it is now-more-than-ever crucial to elect people to the Executive Branch who are willing to appoint them.

It is my sincere hope that this travesty of justice is overturned; and it is my feeling that with Bush's appointment of the new Justice Apparent to the Bench, instances such as this will not only become a rarity, but will also be quickly remedied.
